Introduction
Essal is committed to ensuring the integrity and legality of the content available on our platform. This Takedown Policy outlines the process for reporting and handling content that may infringe on intellectual property rights, violate applicable laws, or otherwise contravene our terms of service within the MENA region.
Reporting Infringement
If you believe that content on Essal infringes your intellectual property rights or violates applicable laws, please submit a detailed written notice to our designated agent. Your notice should include the following information:
- Identification of the Infringed Work: A clear description of the copyrighted work or other intellectual property that you claim has been infringed.
- Identification of the Infringing Content: A detailed description of the content you believe is infringing, including the URL or other location on our platform where the content can be found.
- Your Contact Information: Your name, address, telephone number, and email address to allow us to contact you if further information is required.
- Statement of Good Faith: A statement that you have a good faith belief that the use of the content in the manner complained of is not authorized by the intellectual property owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the intellectual property right that is allegedly infringed.
- Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the intellectual property right that is allegedly infringed.
Review Process
- Initial Review: Upon receipt of a properly formatted notice, our legal team will review the claim to determine its validity.
- Content Removal or Retention: If the notice is deemed valid, Essal may remove or disable access to the infringing content. We may also notify the user responsible for the content about the takedown.
- Counter-Notification: The user whose content has been removed may submit a counter-notification if they believe the content was removed in error. The counter-notification must include:
- User’s contact information.
- Identification of the removed content and its location before removal.
- A statement under penalty of perjury that the user believes in good faith that the content was removed as a result of a mistake or misidentification.
Reinstatement of Content
Upon receipt of a valid counter-notification, Essal may reinstate the content unless the original complainant files a legal action seeking a court order to restrain the user from engaging in infringing activity related to the content on Essal.
Repeat Infringers
Essal reserves the right to terminate user accounts that are subject to repeated claims of intellectual property infringement.
Limitations and Liabilities
Essal is not liable for any damages, direct or indirect, that may arise from the removal of content under this policy. Essal reserves the right to seek damages against any party that submits a false claim of infringement.
Changes to the Policy
Essal reserves the right to modify this Takedown Policy at any time. Changes will be effective immediately upon posting on our website.
